Article 1 Definition
1.1. These General Terms and Conditions apply to all agreements between Praktijk Marijn Schrieken | Zenuwwijs (hereinafter to be referred to as Marijn Schrieken) and the client for meetings and/or individual coaching.
1.2. Client means any person or organisation with whom Marijn Schrieken enters into an agreement to provide meetings and/or individual counselling, regardless of whether the client himself or a third party participates in the meeting and/or individual counselling.
1.3. Participant means the person who actually participates in the event.
1.4. Meetings are understood to mean everything in which a group comes together. This includes trainings, group coaching, retreats, lectures, etc.
1.4. Individual coaching is understood to mean personal sessions. This also includes therapy, neurofeedback, supervision, etc.
Article 2 Realisation of the agreement
2.1. The agreement comes into being when the client registers at https://www.marijnschrieken.nl/ (or subsidiary websites), gives an order verbally or by email or signs an order confirmation from Marijn Schrieken.
2.1a. The client is responsible for providing Marijn Schrieken with sufficient information about his/her mental and physical health, as well as about the use and background of medication etc. In addition, the client is responsible for ensuring that he/she is in a fit state to participate in the coaching session.
2.1b. The use of drugs and alcohol before and during the meetings is not permitted.
2.2. The client has agreed to the general terms and conditions at the conclusion of the agreement.
2.3. Deviations from these conditions are only binding if confirmed in writing by Marijn Schrieken.
Article 3 Cancellation of training and/ session or coaching
3.1. The client has the right to cancel participation in, or order for, a meeting and/or individual coaching by email or in writing.
3.2. In the event of cancellation up to eight weeks before the start of a meeting, an administration fee of €10 shall be charged. In the event of cancellation up to four weeks before the start, 10% of the meeting will be charged. No refund is possible within one month before the start.
3.3. In the event of cancellation less than 30 days before the first meeting, or if the participant terminates the participation after the first meeting or does not take part in the meeting for other reasons, the client will pay the full participation costs, including any outstanding instalments of an instalment payment.
3.3a. The participant may be replaced, provided that the replacement participant meets the admission requirements for the training course in question.
3.3b. The participant gives his/her commitment to participate in all meetings, but in case of illness or other special circumstances he/she cancels in good time.
3.4. The client can cancel the individual coaching up to 24 hours in advance free of charge.
3.5. In case of cancellation less than 24 hours before an individual guidance session, or if the participant does not participate for other reasons, the client will pay the full costs, including any outstanding instalments of an instalment payment.
3.5a. The participant may be replaced, provided that the replacement participant meets the admission requirements for the individual guidance concerned.
3.6. The dates and locations can be rescheduled in exceptional cases (e.g. due to illness of the tutor). Marijn Schrieken will inform the participant as soon as possible. If there are insufficient participants, the meeting may start later or even be cancelled. In the event of cancellation, the client will receive a refund of the registration fee paid.
3.7 Marijn Schrieken has the right to refuse a participant for the event or individual coaching. Marijn Schrieken also has the right to deny a participant access to a meeting. The participant can be asked to leave the meeting for one of the following reasons:
- serious non-compliance with the assignments;
- frequent absence (whether or not due to force majeure);
- serious disruption of the group process;
- improper behaviour (theft, verbal abuse, providing incorrect information);
- negligence in meeting other (such as financial) obligations concerning the meetings/individual guidance.
3.8 In case of reimbursement of the amount paid by the client to Marijn Schrieken, a payment term of 30 days will be observed.
Article 4 Payment
4.1. Marijn Schrieken will charge the participation fee by means of an invoice. The client must pay the participation fee at least 30 days prior to the first meeting and/or individual coaching. If that date has already passed, it is no later than 14 days after registration but at least before the first meeting and/or individual coaching has taken place. Invoices sent by Marijn Schrieken are subject to a payment term of 14 days, unless otherwise stated.
4.1.a. Payment in instalments is possible but only after consultation. If the payment obligation is not met, the full amount can still be claimed at once.
4.2. If payment is not made on time, the client is required to reimburse Marijn Schrieken for reasonable judicial and extra-judicial collection costs.
4.3. If the client has not provided timely payment, the participant is responsible for payment.
Article 5 Liability
5.1. Marijn Schrieken endeavours to carry out the given sessions and/or individual coaching to the best of its abilities.
5.2. Marijn Schrieken is liable to client and participant only for damages that are the direct result of demonstrable intent or deliberate recklessness, up to an amount of the amount of the meetings and/or individual guidance per damaging event, whereby a consecutive series of events is considered as one event.
5.3. Marijn Schrieken is not liable for indirect damages such as consequential damages, loss of profit and damage due to business interruption.
5.4. Marijn Schrieken is not liable in the event that the client, participant, or a third party has the possibility to appeal to an insurance company.
5.5. Dutch law is applicable to the assignment agreement and the relationship with the participant. Disputes arising from the power relationship are subject to the exclusive jurisdiction of the Dutch courts.
5.6. The participant is always responsible for the choice of, and manner of participating in, exercises during the meetings and individual coaching, and possible consequences of this for his/her health. As a result, the participant/client cannot hold the facilitator and Marijn Schrieken liable for any damages resulting from this. Marijn Schrieken cannot be held responsible for the management of personal belongings during the meetings/individual guidance.
5.7. The participant is solely responsible for damage caused by him/her to the belongings of others, to the group space or facilities rented or used for the meeting/individual counselling.
Article 6 Secrecy and confidentiality
6.1. Information provided by participants is treated confidentially by Marijn Schrieken, its staff and/or persons working for Marijn Schrieken.
6.2. Marijn Schrieken complies with the applicable privacy laws.
6.3. The copyright and ownership of all materials provided belongs to Marijn Schrieken, unless otherwise stated.
